They are also joining Central TUs and Federations in the National level Campaigns......

DEFENCE Production Units under  ORDINANCE BOARD are being Corporatized. 

All the three Recognized Federations, AIDEF, INTUC and BMS have decided to go for ONE MONTH STRIKE .......

SAIL UNITS and other PSUs are also prepared for continuous struggles.....

In the meanwhile All INDIA PROTEST DAY is being organised by Central TUs and National Federations against LABOUR LAW AMENDMENTS through Codification, which will take away the existing rights of the Working People in the Country...

The Govt has openly said that the CODES are for Ease of Doing Business.

IT IS THE TIME TO GO FOR ACTION....

Sub:   Submission of Memorandum on long pending demands.
Sir,
            It is to bring to your kind notice that on so many occasions, we as PJCA have raised our long pending genuine demands before the Department. But it is highly regretted that no effective steps have been taken by the Department to mitigate the problems causing more sufferings to the employees.
            After introduction of technology in the form of CBS/CSI/CIS/MNOP/PNOP & now RICT the staff is suffering very much. We are bringing all the problems being faced by the staff at ground level separately on each subject but no solution is coming out.
            A meeting of Postal Joint Council of Action consisting NFPE,FNPO,AIPEU-GDS & NUGDS was held at FNPO Office. T-24, Atul Grove Road New Delhi on  13.07.2019. In the meeting all General Secretaries, of NFPE, FNPO AIPEU-GDS and NUGDS participated. After thorough discussion, PJCA has come to the conclusion that a memorandum should be submitted to Secretary (Post) for settlement of demands as mentioned in the Charter of Demands enclosed here with.
            We request you to kindly arrange one meeting with office bearers of PJCA to discuss the issues and settle the same as early as possible failing which we (PJCA) will be compelled to launch agitational programmes in a phased manner.

CHARTER OF DEMANDS
1.    Settle all the problems arisen out of implementation of C.S.I, R.I.C.T./ IPPB / CBS and Postmen delivery mobile App & CIS.
2.    Implement all positive recommendations of Sri Kamlesh Chandra Committee report and grant Civil servant Status to GDS.
3.    Fill up all Vacant Posts in all cadres of Department of Post i.e. P.A/S.A, Postmen, Mail Guard, Mailmen, MMS, MTS, GDS, Postal Acctts, P.A  Admn. Offices, P.A SBCO & Civil Wing etc  within a time frame  and separate identity of all cadres.
4.    Withdraw NPS and Guarantee minimum pension 50% of last pay drawn.
5.    Membership verification of G.D.S and declaration of result of regular employees membership verification conducted in 2015.
6.    Implementation of orders of   payment of  revised wages and arrears to the casual , Part time, Contingent employees & daily rated mazdoors as per 6th and  7th CPC and Regularize Services of casual Labourers.
7.    Implement Cadre Restructuring for left out categories i.e. RMS, MMS, Postman/MTS, PACO, PASBCO, Postal Accounts, and Civil Wing etc.
8.    Stop Privatization, Corporatization and out sourcing in Postal Services.
9.    Scrap Bench Mark in MACP.
10.  Implement 5 days week in Postal and RMS
11.  Enhancement of higher pay scales to those categories whose minimum qualification has been enhanced e.g. Postmen, Mail guard.
12.  Grant of pension to the promoted GDS based on Supreme Court Judgment in SLP No (C) 13042/2014
13.  Withdraw orders of enhancement of cash conveyance limit without security.
14.   Implement all High Court and Supreme Court decisions in C/W MACP, RTP and others.
15.  Cash less treatment under CGHS  and allotment of adequate fund under head MR & T.A
16.  Retention of Civil wing in the Department of Post.
17.  Holding of Departmental Council Meetings/RJCM and periodical meetings at all levels.
18.  Stop Trade Union victimization and in the name of unscientific targets.
19.  Provide 40 percent SCF quota promotion in AAO cadre and amend RR incorporating the modifications demanded by AIPAEA.
20.  Status of audit to SBCO.
21.  Restore Special Allowance to PO & RMS Accountants and OSA to RMS/MMS Staff.
22.  All NSH and I.C. Speed Post Hubs should be under the administrative control of RMS and All L-2 Mail Offices should be identified as I.C. Speed Post Hubs and as Parcel Hubs.
23.  Permission to all Staff of Circle Office, SBCO, Postal Accounts and RMS/MMS Staff to appear in Departmental Examination for promotion to PSS Group-B.
24.  Improper functioning of Separate (Nodal) Parcel Delivery in India Post vis-a-vis heavy expenditure and undue harassment to the Postmen Delivery staff.

PRESS RELEASE
CTUs – INTUC, AITUC, HMS, CITU, AIUTUC, TUCC, SEWA, AICCTU, LPF, UTUC and
Independent Federations/Associations - take strong objection and condemn bulldozing of codification of labour laws and other laws in spite of strong objections from the trade union movement.

The government have made known their intention to codify various labour laws through an unconstitutional method of making it a part of the budget speech on 5.07.2019, ignoring the state jurisdiction of concurrent list in the Constitution.

Now, on 23.07.2019, the government has introduced the Code on Wages Bill 2019 and the Occupational  Safety,  Health  and  Working  Conditions  Code  Bill  2019  in  Lok  Sabha.  The contents of both the Bills totally ignore all the points of oppositions and reservations on various provisions of both the Bills curtailing the rights of the workers and are prejudicial to their interests raised by all the central trade union organizations.

Contrary  to  the  claims  by  the  Government,  these  codes  would  enhance  the  process  of exclusion of workers from the benefits they accrue from the existing laws, by simply raising the threshold level of number of workers for application of those laws.

The wage code has denied the agreed formula of wage calculation as per 15th Indian Labour conference, and add on 25% as directed by Supreme Court judgment in Raptakos case and which was repeatedly and unanimously accepted by 45th and 46th ILC. The Expert Committee appointed by the Central Government, which excluded any participation from the Trade Unions, to determine the methodology to determine the National Minimum Wage also went against those recommendations. But to top it all the Labour Minister, on 10.07.2019 unilaterally announced the National Minimum Wage as Rs. 4628/-pm, when even the 7th CPC recommends Rs.18000/-pm as the minimum wages w.e.f. 1.01.2016.

The  Code on Occupational  Safety,  Health  and Working  Conditions Bill  2019  replaces  13 existing Labour laws, making it applicable to the establishments, with ten workers, thus keeping
90 percent of workforce which is from unorganised sector/informal economy sector, out sourced on contract and home based sector would be out of the purview of the code.

Most of these laws were enacted to address and regulate the service conditions of different segments of workers and employees like Sales Promotion Employees, Mines, Beedi, Construction, Working Journalists and Newspaper  Employees  etc  in  accordance  with  and taking care of the aspects relating their respective occupation specificities and peculiarities which were different and widely varying from one another. By repealing all these Acts and selectively picking up the provisions advantageous to employers only from these Acts for incorporation of the Code Bill and grossly diluting and/or tampering all the provisions pertaining to rights and protection of the workers in general, the Govt seeks to drastically curtail the workers’ rights, in their most obedient services of their corporate masters.

Even on Health and Safety related matters, the Code has so articulated the provisions as the workers and their unions cannot assert their opinions and rights for proper enforcement or establish the accountability of the employers for violation of even the basic health and safety provisions which is a common and daily phenomenon in the workplaces across the sectors throughout the country leading to loss of lives and disabling injuries almost every day.

On 23.07.2019, the Central Government, by its brute majority in the Parliament, passed the hated Motor Vehicles Bill, opposed with stupendous strikes by transport workers federations through out the country since 2014, making it into an Act.
This is a clear indication of how undemocratically the BJP Government will work, in spite of all
the declarations of “Sabka Saath, Sabka Vishwas”.

The CTUs condemn such anti-worker moves of the Government and call upon the workers, their  unions and federations, irrespective of  affiliations, to observe 2nd   August, 2019, with countrywide united protest and raise the demand to withdraw the proposed anti-worker legislations, ignoring all norms of international labour standards.

The CTUs also call upon the Members of Parliament to oppose these undemocratic methods used by the ruling party to bulldoze anti-worker legislations, bypassing tripartism and normal legislative procedure.

However, this result of the final outcome of the Writ Petition No. 6895 of 2015 pending before the Hon`able High Court of Rajasthan at Jodhpur.

3. With regard to the category of Supervisors (General Line) , it is stated that as per the Order dated 06.05.1997 in CWP No. 1827/97 passed by the Hon`able High Court of Delhi, the All India Assistant of Postal Supervisors (GL) representing this cadre will continue to be recognized till such time the interim order of the Hon`ble Court is in force.

4. With the issue of this Office Memorandum the trade union facilities availed by those Service Associations/Unions who got recognition in the year 2010 but has not qualified in the year 2015 in respect of above categories of staff stand withdrawn.
